Acceptable Use Policy

0. Definitions

• "Platform" means SalesGPT.work, including the web app, APIs, agents, and related services.
• "Agents" means AI-enabled features used for enrichment, content generation, outreach, or workflows.
• "Customer Data" means data submitted to the Platform by or on behalf of a user (contacts, lists, CRM exports, prompts).
• "User Content" means any text, files, inputs, prompts, or other content you upload or provide.
• "AI Output" means content generated by the Platform or Agents (emails, sequences, copy, summaries, suggestions).
• "Sensitive Data" includes special category data (GDPR Art. 9), children's data, and high-risk identifiers under applicable law.

1. Acceptable Use

SalesGPT.work is designed to support legitimate business and professional sales activities. Users must:

• Use the Platform only for lawful, authorized business purposes.
• Maintain integrity and transparency when using AI outputs in communication or decision-making.
• Respect intellectual property and confidentiality of data.

Customer admin responsibility (operational)

• Maintain appropriate access controls and revoke access promptly when personnel change.
• Do not share credentials; use role-based access where available.
• Ensure internal sales/marketing/privacy/security policies align with Platform usage.

1A. User Responsibility for Compliance

Your Legal Responsibility: You are solely responsible for ensuring your use complies with laws, regulations, and third-party terms, including:

• Data Protection Laws: lawful basis (consent, legitimate interest, contract) under GDPR, CCPA/CPRA, CASL, or other laws.
• Anti-Spam Compliance: proper consent and record-keeping (e.g., CASL proof of opt-in for 3 years).
• Content Accuracy: validate AI-generated content before use or publication.
• Intellectual Property: ensure rights to upload content and outputs do not infringe third-party IP.
• Outreach Compliance: comply with CAN-SPAM, CASL, GDPR e-privacy, and similar laws.

No Guarantee of Compliance: SalesGPT.work provides tools but does not guarantee compliance. You assume liability for your use and any violations.

2. Prohibited Activities

Users are prohibited from activities compromising integrity, security, or reputation of SalesGPT.work, including:

• Sending spam, fake leads, or unsolicited messages.
• Impersonating individuals or entities.
• Third-Party Website Scraping: scraping/crawling/harvesting personal data from third-party websites (LinkedIn, X/Twitter, Facebook, etc.) in violation of their Terms or applicable laws.
• Reverse engineering, decompiling, or scraping Platform data or models.
• Prompt injection, jailbreaking, or attempts to extract proprietary data.
• Uploading unlawful, offensive, misleading, hateful, discriminatory, violent, or harmful content.
• Bypassing rate limits, security protocols, or authentication systems.
• Account & Credential Abuse: sharing credentials, reselling access, or using one account for multiple unrelated entities without authorization.
• Financial Fraud: pump-and-dump schemes, fraudulent investment offers, or scams.

3. AI-Specific Protections

• Do not manipulate or override AI behavior via malicious prompts or jailbreaking.
• Do not use outputs for illegal, discriminatory, or unethical purposes.
• Do not represent AI-generated content as human-authored without disclosure where required by law (including the EU AI Act).
• Do not use outputs for misinformation, impersonation, or deception.
• Deepfakes & Synthetic Media: generating deceptive synthetic media of real individuals is prohibited; political influence operations are prohibited.
• Do not input personal data without lawful basis or consent where required.
• Do not use outputs to infringe intellectual property rights.

3.1 AI Output Accuracy & User Verification

AI Output Disclaimer: Outputs may be inaccurate or incomplete and are decision-support tools only.

User Verification Obligation: You must review and validate outputs before use, including:

• Verifying accuracy of claims, offers, and statements.
• Ensuring compliance with advertising standards and anti-spam rules.
• Checking for IP violations, defamation, or legal issues.
• Not blindly automating sending without human review.

No Liability for AI Outputs: You assume liability for harms arising from use of outputs.

3.2 Automated Decision Making (GDPR Article 22 Compliance)

Users may not use SalesGPT.work to make automated decisions with legal or similarly significant effects (credit, employment, healthcare eligibility, loan approvals) without meaningful human oversight and final human sign-off.

3.3 EU AI Act Compliance

Prohibited AI Uses: Use for "Social Scoring" or "Emotion AI" in workplace/education is prohibited, including:

• Scoring individuals' trustworthiness/social behavior/emotions.
• Emotion recognition or biometric categorization in workplace/education contexts.
• Real-time remote biometric identification in public spaces (except lawful law enforcement use).

3A. Sensitive Data Prohibition

Prohibited Data Categories: You may not upload, process, or enrich these categories unless permitted by law with safeguards:

• Health Data: medical records, health conditions, biometric/genetic data.
• Financial Data: bank account numbers, credit card numbers (except payment processing), credit scores, transaction details.
• Children's Data: personal data of individuals under 18 without parental consent.
• Special Category Data (GDPR Art. 9): race/ethnicity, political opinions, religious beliefs, trade union membership, sexual orientation, biometric ID data.

If you believe you qualify for an exception, contact us for approval before processing: admin@salesgpt.work.

3B. Data Privacy & Consent for Uploads

• You have necessary consents and lawful bases (GDPR, CCPA/CPRA, CASL, etc.).
• You maintain proof of consent where required (e.g., CASL opt-in records for 3 years).
• You have the right to share data with SalesGPT.work as a processor.
• Data was obtained lawfully and not via unauthorized scraping, harvesting, or breaches.

Your Sole Responsibility: SalesGPT.work acts as a Data Processor on your documented instructions.

4. Fair Usage Limits

• API Rate Limits: subject to plan-based limits; excessive requests may be throttled or suspended.
• Credit Consumption: abusive patterns (credit farming, database draining) may result in suspension.
• Automation Safeguards: unattended scripts/bots degrading service quality are not permitted.
• Enterprise/API Usage: must comply with quotas and developer guidelines per your plan.

Exceeding limits may result in throttling, suspension, or termination depending on severity and frequency.

4A. Email & Outreach Rate Safeguards

• Domain Warm-up: new domains/accounts must follow warm-up procedures before bulk sending.
• Bulk Sending Thresholds: daily limits apply per plan; exceeding may trigger throttling/suspension.
• Cold Outreach Prohibition (EU): prohibited without lawful basis as required under GDPR e-privacy.
• Bounce Monitoring: bounce rates > 5% or spam complaints > 0.1% may trigger suspension.
• Unsubscribe Compliance: functional unsubscribe required; honor opt-out within 10 business days (CAN-SPAM).

5. Security & Reporting Obligations

• Report vulnerabilities responsibly to admin@salesgpt.work.
• Unauthorized penetration testing, exploit development, or scanning is prohibited.
• Do not access other users' data, prompts, or workspaces.

6. Third-Party Integrations & Data Handling

• Ensure lawful grounds/consents for data sharing with third parties.
• Review OAuth scopes/permissions before authorizing integrations.
• Monitor for suspicious activity and disconnect risky integrations.
• Comply with third-party Terms of Service and privacy policies.

Limited Liability: SalesGPT.work is not responsible for third-party services or their breaches/policy changes.

Integration Suspension: We may disable integrations posing security/compliance risks.

6A. Intellectual Property Protections

• Do not generate/upload/distribute content infringing trademarks, copyrights, trade secrets, or patents.
• You warrant you have rights to upload content and that outputs do not infringe third-party IP.

7. Examples of Misuse (Illustrative)

• Scraping contact lists, harvesting emails, buying fake leads.
• Uploading lists without lawful basis or authorization.
• Bypassing authentication, rate limits, or security protocols.
• Political influence operations, coordinated disinformation, simulating candidates.
• Fake testimonials, deceptive synthetic media, fraudulent offers.
• Sharing credentials, reselling access, multi-entity misuse.

This list is not exhaustive; similar activities are also prohibited.

8. Enforcement Framework

SalesGPT.work applies a three-tier enforcement approach:

• Tier 1: Warning for minor/first-time violations.
• Tier 2: Temporary suspension for repeat/serious violations.
• Tier 3: Permanent ban and account termination for severe abuse.

Severe Violations (Immediate Termination): illegal activity, data theft, large-scale spam, repeated violations, security threats, or significant harm to the Platform/users.

Report misuse: admin@salesgpt.work. Appeals within 10 business days with details and remediation steps.

9. Professional Disclaimer

Agent outputs are informational and not licensed legal/financial/accounting advice. You are the "Final Editor" and assume responsibility for accuracy, legality, and appropriateness of communications.

10. Jurisdiction & Cross-Border Compliance

Users must comply with all applicable laws (GDPR, CCPA/CPRA, CASL, DPDP Act, etc.). Subject to mandatory consumer/data protection laws, this AUP is governed by the laws of India, with courts at Ajmer, Rajasthan having exclusive jurisdiction for non-data-protection disputes.

11. Anti-Spam Compliance

• CAN-SPAM (US): sender identification, accurate subject lines, opt-out, physical address; honor opt-outs within 10 business days.
• CASL (Canada): express or implied consent; maintain proof of opt-in for 3 years.
• GDPR e-Privacy (EU/UK): consent required for marketing emails; limited legitimate interest cases; honor opt-outs promptly.

SalesGPT.work provides tools but does not guarantee compliance.

12. No Data Brokerage

Using the Platform to sell, license, or commercially redistribute personal data, enriched data, or contact lists is prohibited unless expressly permitted by law.

13. Legal Provisions

This policy is read alongside the Terms of Service and Privacy Policy. SalesGPT.work complies with GDPR, CCPA, and India's Digital Personal Data Protection Act (DPDPA).

14. Policy Updates

This AUP may be updated periodically. We will notify updates via email, in-platform notice, or website notice. Continued use after updates constitutes acceptance.

15. Relationship to Other Policies

This AUP supplements our Terms of Service, Privacy Policy, and Data Processing Addendum. If there is a conflict, Terms of Service prevail except for data protection matters, where the Privacy Policy and DPA prevail.
